Representing Burn Injury Victims in New York

A burn injury occurs when the skin or other tissues of the body are damaged due to exposure to heat, electricity, chemicals, radiation, or friction. Burns can range from minor injuries that require little or no medical treatment to severe injuries that can be life-threatening.

The most common causes of burn injuries are:

  • Workplace accidents
  • Construction accidents
  • Defective products
  • Electrocution
  • Hazardous materials
  • Premises liability

These accidents can result in severe burns, which can require extensive treatment and may leave the victim permanently scarred or disfigured. If you or a loved one has suffered a serious burn injury, the New York City burn injury lawyers at Sutton & Smyth, LLP can help. We have decades of combined experience and have recovered millions of dollars for our clients. Types of Burns

There are four different types of burns, each of which is classified by the severity and depth of the tissue damage. These burns are:

First-Degree Burn

First-degree burns are the least severe type of burns. They only damage the outer layer of the skin, called the epidermis. First-degree burns are often caused by sunburn and can be treated at home. Symptoms of a first-degree burn include redness, pain, and minor swelling.

Second-Degree Burn

Second-degree burns are more severe than first-degree burns. They damage both the epidermis and the layer of skin beneath it, called the dermis. Symptoms of a second-degree burn include redness, pain, swelling, and blistering. If a second-degree burn is larger than two to three inches, it is considered a major burn and should be treated by a medical professional.

Third-Degree Burn

Third-degree burns are the most severe type of burns. They damage all of the layers of the skin, as well as the fatty tissue beneath the skin. Symptoms of a third-degree burn include white or blackened skin, numbness, and charred skin that may be peeling or falling off. Third-degree burns can cause permanent scarring and may require skin grafting.

Fourth-Degree Burn

Fourth-degree burns are the most severe type of burns and can be fatal. They damage all of the layers of the skin and the underlying muscle and bone. Fourth-degree burns can cause permanent scarring and may require amputation.

How Long Does It Take to Heal from a Burn Injury?

The time it takes for a burn injury to heal depends on the severity of the burn. First-degree burns usually heal within 7 to 10 days. Second-degree burns usually heal within 2 to 3 weeks. Third-degree burns usually take several months to heal and may require multiple surgeries. Fourth-degree burns are the most severe type of burns and can take years to heal, if they heal at all. Many burn victims are left with permanent scarring and disfigurement.

Can You Sue for a Burn Injury?

If you or a loved one has suffered a serious burn injury due to the negligence of another person or entity, you may be entitled to compensation. To recover compensation for a burn injury, you must prove that:

  • The defendant owed you a duty of care;
  • The defendant breached the duty of care;
  • The breach of the duty of care caused your burn injury; and
  • You suffered damages as a result of your burn injury.

For example, if you suffered a burn injury in a car accident, you may be able to prove that the other driver breached the duty of care by driving recklessly and that the breach of the duty of care caused your burn injury. You may be able to recover compensation for medical expenses, lost wages, and pain and suffering.
